1. Agreement to Terms
These Terms of Service (the "Terms") govern your access to and use of the Bevyl website, applications, and related services (the "Service"). By accessing or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
Effective date: February 5, 2026.
2. Eligibility
You must be at least 13 years old (or older if required by the laws of your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement.
3. Accounts and Security
- You are responsible for maintaining the confidentiality of your account credentials.
- You agree to provide accurate and complete information and keep it up to date.
- You are responsible for all activity that occurs under your account.
4. Subscriptions, Trials, and Billing
- Paid plans renew automatically until canceled. You authorize us (and our payment processor) to charge your payment method for recurring fees and taxes.
- Free trials (if offered) automatically convert to a paid subscription unless canceled before the trial ends.
- You can cancel at any time, and cancellation will take effect at the end of the current billing period unless otherwise stated.
- Fees are non-refundable except where required by law.
Payments are processed by a third-party payment processor. We do not store full payment card numbers.
5. Usage Credits
Some features may be provided through usage credits or one-time packs. Credits are non-transferable and expire or are consumed as described at purchase or in the Service.
6. Your Content and License
- You retain ownership of the content you upload or create, including videos, images, audio, text, and brand assets ("User Content").
- You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, modify, and display User Content solely to provide and improve the Service.
- You represent that you have the rights and permissions necessary to submit User Content and that your User Content does not infringe third-party rights.
7. Acceptable Use
- Do not use the Service for unlawful, harmful, or abusive activity.
- Do not upload content that infringes intellectual property or privacy rights.
- Do not attempt to access, probe, or disrupt the Service or its infrastructure.
- Do not reverse engineer or circumvent security or usage limits.
8. AI Features and Outputs
The Service uses automated and AI-assisted tools to analyze and edit content. Outputs may be inaccurate, incomplete, or unsuitable for your intended use. You are responsible for reviewing and validating outputs before publication or distribution.
9. Third-Party Services
The Service integrates with third-party services (such as payment, analytics, hosting, and AI providers). We are not responsible for third-party services and their terms or policies.
10. Feedback
If you provide feedback, suggestions, or ideas, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them without restriction or compensation.
11. Suspension and Termination
- We may suspend or terminate access if you violate these Terms or if required by law.
- You may stop using the Service at any time. Cancellation of a paid plan is handled via your account settings or billing portal.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Bevyl WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
14. Indemnification
You agree to indemnify and hold harmless Bevyl and its affiliates, officers, employees, and agents from any claims, damages, liabilities, and expenses arising from your use of the Service or your User Content.
15. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will provide notice by posting the updated Terms and updating the "Last updated" date.
16. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict of laws principles. Any disputes will be resolved in the state or federal courts located in New York.
